Terms of Service

The rules for using Formloop, including what forms may and may not be used for.

Agreement

These Terms are an agreement between you and wisegrids ("we", "us", "our"). They cover Formloop, which includes:

  • our website
  • the Formloop app in ChatGPT
  • the web dashboard
  • forms published with Formloop

Together these are the "Service". By using the Service, you agree to these Terms and to our Privacy Policy.

If you use the Service for an organisation, you confirm that you're authorised to accept these Terms on its behalf, and "you" includes that organisation.

Eligibility

You must be at least 18 years old, or the age of majority where you live, and legally able to enter into this agreement.

You can't use the Service if you're barred from doing so by law, or if we've previously suspended your account for breaking these Terms.

Your account

Give accurate information when you sign up, and keep your sign-in details secure. You're responsible for what happens on your account. Tell us straight away if you think someone has accessed it without permission.

When you connect Formloop to ChatGPT, you authorise ChatGPT to use your Formloop account when you ask it to. You're responsible for the actions taken that way. You can disconnect at any time in ChatGPT's settings.

The Service and AI-generated content

  • Check what the AI builds. Formloop uses AI to build and change forms. AI-generated content can be inaccurate, incomplete or unsuitable for your purpose, so review your form before you publish it. You're responsible for the forms you publish.
  • Published forms are public. Anyone with the link can see and fill in a published form.
  • ChatGPT is a separate service. OpenAI provides ChatGPT under its own terms. Formloop is independent and not affiliated with OpenAI, and we're not responsible for ChatGPT's availability or its answers.

Your content and respondent data

You own your content. That means your forms and the responses they collect.

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and process your content. We use this licence only to provide and improve the Service, as described in our Privacy Policy. It ends when your content is deleted from our systems.

You're responsible for the data you collect. For responses to your forms, you are the controller and we process them on your behalf. You must:

  • have a lawful basis for the information you collect
  • collect only what you need
  • give respondents any privacy notice the law requires
  • handle their requests to access or delete their data

Acceptable use

Keep forms honest and safe. You must not use the Service to:

  • Phish or deceive. This includes impersonating a person, brand or organisation, or building forms that trick people into revealing information.
  • Collect sensitive data the Service isn't built for. That means passwords or other sign-in credentials, full payment card numbers, bank account credentials, government ID numbers (for example passport, social security or Aadhaar numbers), and health information subject to special legal protection (for example under HIPAA).
  • Collect children's data unlawfully. Don't collect personal data from children without verifiable parental consent where the law requires it.
  • Spam people. Don't send spam, or use forms to collect contacts for unsolicited messages.
  • Spread malware. Don't distribute malware, or links to it.
  • Harm people. Don't harass, threaten or defame anyone, or promote violence or hatred.
  • Publish sexual content. Sexually explicit material is not allowed. Any content that sexually exploits children is removed and reported to the authorities.
  • Promote illegal or restricted things. That includes illegal goods or services, gambling, weapons and drugs.
  • Infringe others' rights. Respect other people's intellectual property and privacy.
  • Track people secretly. Don't carry out surveillance or profile people without their knowledge.
  • Break the law. This includes privacy, consumer protection and anti-spam laws.

You also must not:

  • Attack the Service. Don't interfere with or disrupt it.
  • Test our security without permission. If you're a security researcher, email us first.
  • Get around our limits. That includes usage limits, rate limits and access controls.
  • Create accounts in bulk. Don't create accounts automatically or in bulk, for example to evade limits.
  • Scrape the Service.
  • Reverse engineer it, except where the law allows.
  • Resell the Service without our written agreement.
  • Copy the Service to build a competing product.

When you use Formloop through ChatGPT, OpenAI's usage policies also apply.

Enforcement. If you break these rules, we may remove or disable forms, suspend or close accounts, and report illegal activity to the authorities. We'll usually tell you first, unless that would be unlawful or would put people at risk.

Reporting abuse. To report a form, email wisegrids@gmail.com with its link.

Plans, fees and payment

  • Free plan. It has the usage limits shown on our website. We may change those limits; we'll give notice before any change that reduces what you can do.
  • Paid plans. They're billed in advance, monthly or yearly, through our payment provider. That provider may act as the merchant of record, and its terms apply to the transaction.
  • Renewal and cancellation. Subscriptions renew automatically until you cancel. You can cancel at any time, and the cancellation takes effect at the end of the current billing period.
  • Taxes. Prices don't include taxes unless we say so.
  • Refunds. Fees are non-refundable, except where the law requires otherwise.
  • Price changes. We'll give you at least 30 days' notice. New prices apply from your next billing period.
  • Reaching a limit. If you reach a plan limit, we may pause new responses until your next billing period or until you upgrade. We never delete responses you've already collected because you reached a limit.

Our intellectual property

We own the Service, including its software, design and branding. These Terms only give you the right to use it.

Forms on the free plan show a small "Made with Formloop" badge. Don't remove or hide it.

If you send us feedback, we may use it without owing you anything.

Third-party services

The Service works with services run by other companies, such as ChatGPT, sign-in providers and our payment provider. Your use of those services is governed by their own terms, and we're not responsible for them.

Changes and availability

We're always improving the Service and may add, change or remove features. If we make a significant change that reduces a paid feature, we'll give you reasonable notice.

We aim for high availability, but we don't promise the Service will always be available or free of errors. It may be paused for maintenance.

Ending this agreement

You can stop using the Service and ask us to delete your account at any time.

We may suspend or end your access if you break these Terms, if your use puts other people or the Service at risk, or if the law requires us to.

When your access ends, your right to use the Service ends too. Where it's lawful and safe, we'll give you a chance to export your data first. After that, we delete it as described in our Privacy Policy.

The sections that by their nature should continue (for example on liability, indemnity and governing law) remain in effect after the agreement ends.

Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.

Our total liability for all claims relating to the Service is limited to the greater of:

  • the amount you paid us in the 12 months before the claim
  • USD 100

Some jurisdictions don't allow some of these limits. Where that's the case, they apply only as far as the law permits.

Indemnity

You'll defend and indemnify us against claims, damages and costs, including reasonable legal fees, that arise from any of the following:

  • your content
  • the forms you publish
  • how you collect and use respondent data
  • your breach of these Terms

Governing law

These Terms are governed by the laws of India, and its courts have exclusive jurisdiction over any dispute about them. This doesn't take away any protection you have under the consumer laws of the country where you live.

Changes to these Terms

When we update these Terms, we'll change the date at the top of this page. For significant changes, we'll give you at least 14 days' notice by email or in the Service. If you keep using the Service after a change takes effect, you accept the updated Terms.

General

  • Entire agreement. These Terms and our Privacy Policy are the whole agreement between us.
  • Severability. If any part is found unenforceable, the rest still applies.
  • No waiver. If we don't enforce a provision, we haven't given up the right to enforce it later.
  • Transfers. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
  • Force majeure. We aren't responsible for delays caused by events outside our reasonable control.
  • Notices. We'll send notices to your account's email address.
